The Registration Act, 1908, the Transfer of Property Act, 1882 and the Real Estate (Regulation and Development) Act, 2016 mandates the registration of an agreement for sale of an immovable property. Whether you need to pay stamp duty on a property transferred as a gift depends on the laws of the specific jurisdiction where the property is located. Generally, many regions impose stamp duty on property transfers, including gifts, typically calculated based on the property’s market value.  Despite any applicable exemptions, you may still need to complete and submit relevant documentation to the tax authorities.
